Terms of Service

1. Acceptance of Terms

By accessing or using PropInvestor ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service. These Terms form a legally binding agreement between you and PropInvestor (ABN to be advised), operated from New South Wales, Australia.

2. Account Registration & Responsibilities

You must provide accurate information when creating an account via Google OAuth. You are responsible for maintaining the security of your account and for all activities that occur under it. You must notify us immediately of any unauthorised access. You must be at least 18 years old to use this Service.

3. Subscription & Billing

PropInvestor offers a free tier and a paid Investor subscription ($7.99/month AUD, inclusive of GST). Paid subscriptions are billed monthly via Stripe and auto-renew unless cancelled. All payment processing is handled by Stripe Payments Australia Pty Ltd; PropInvestor does not store or have access to your credit card details. Your payment will appear on your statement as "PROPINVESTOR" or similar.

We reserve the right to change pricing with 30 days' written notice to your registered email address. Price changes will not affect your current billing period. See our Refund & Cancellation Policy for cancellation and refund details.

4. Acceptable Use

You must not: scrape or programmatically extract data from the Service; redistribute suburb data, reports, or analytics to third parties; use the Service for any unlawful purpose; interfere with the Service's operation or security; or use the Service to provide financial advice to third parties without an appropriate Australian Financial Services Licence (AFSL).

5. Intellectual Property

PropInvestor owns all rights to the platform, including its software, design, and aggregated data. You retain ownership of the property and financial data you enter. We do not claim any rights over your personal data. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service to you.

6. No Financial Advice Disclaimer

PropInvestor does not hold an Australian Financial Services Licence (AFSL). The Service provides financial projections, suburb metrics, and investment analysis tools for general informational and educational purposes only. This information:

  • Does not constitute personal financial advice, tax advice, or legal advice
  • Does not take into account your personal objectives, financial situation, or needs
  • Should not be relied upon as the sole basis for any investment decision
  • May contain estimates that differ from actual outcomes

You should obtain independent professional advice from a licensed financial adviser, tax agent, or solicitor before making any property investment decision. Past performance data and projections are not indicative of future results.

7. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

If the Service fails to meet a consumer guarantee, you are entitled to the remedies available under the Australian Consumer Law, including a refund for a major failure or compensation for any other reasonably foreseeable loss or damage.

8. Limitation of Liability

Subject to clause 7 (Australian Consumer Law), and to the maximum extent permitted by law, PropInvestor's total aggregate liability to you for all claims arising from or relating to your use of the Service is limited to the total subscription fees you have paid to us in the 12 months preceding the claim.

Subject to clause 7, PropInvestor is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of profits, investment losses, or data loss. This limitation does not apply to liability that cannot be excluded by law.

9. Service Availability

We aim to provide the Service continuously but do not guarantee uninterrupted availability. We may suspend the Service temporarily for maintenance, updates, or circumstances beyond our reasonable control (including but not limited to internet outages, natural disasters, or third-party service failures). We will use reasonable efforts to notify you of planned maintenance in advance.

10. Termination

We may suspend or terminate your account if you materially breach these Terms and fail to remedy the breach within 14 days of our written notice. Upon termination, your right to use the Service ceases immediately. We will provide you with a reasonable opportunity (at least 30 days' notice except in cases of serious breach) to export your data before account deletion. Termination does not affect any rights or obligations that accrued prior to termination.

11. Indemnification

You agree to indemnify PropInvestor against any third-party claims arising from your breach of these Terms or your misuse of the Service, except to the extent that the claim arises from our own negligence or breach.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia. Before commencing legal proceedings, the parties agree to attempt to resolve any dispute through good faith negotiation for a period of at least 14 days. If the dispute cannot be resolved, it shall be subject to the non-exclusive jurisdiction of the courts of New South Wales. Nothing in this clause prevents you from seeking urgent interim relief or lodging a complaint with a relevant regulatory body.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

14. Changes to Terms

We may update these Terms from time to time. We will notify registered users via email at least 30 days before material changes take effect. If you do not agree with the revised Terms, you may cancel your subscription and cease using the Service before the changes take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and PropInvestor regarding the Service and supersede all prior agreements and understandings.
